This page outlines the terms and conditions that govern the use of our website and services. Our goal is to ensure a clear understanding and mutual agreement between us and our valued clients.

1. MANDATORY SERVICE FEE
OF $80 INCLUDED FOR ANY PROJECT UNDER $399. OUR STARTING PROJECT RATES ARE EQUAL TO $250 AND ABOVE.
50% OF THE PROJECT VALUE MUST BE PAID FOR ANY PROJECT OVER $399. IF REFUND IS REQUESTED, YOU WILL BE REFUNDED ONLY HALF OF YOUR ORIGINAL DEPOSIT PAYMENT.
MOCK-UPS ARE FREE DURING THE PROCESS OF THE PROJECT.
ANY MOCK-UPS REQUESTED AFTER THE PROJECT THAT EXCEEDS 2 ITEMS WILL BE CHARGED A FEE OF $50.
2. INTELLECTUAL PROPERTY RIGHTS:
ALL DESIGNS, GRAPHICS, AND OTHER CREATIVE WORKS (COLLECTIVELY REFERRED TO AS "WORKS") CREATED BY S7NBYAP ARE PROTECTED UNDER THE INTELLECTUAL PROPERTY LAWS OF THE STATE OF FLORIDA. UPON FULL PAYMENT, THE CLIENT IS GRANTED A NON-EXCLUSIVE, NON-TRANSFERABLE LICENSE TO USE THE WORKS FOR THE INTENDED PURPOSE AS AGREED UPON. S7NBYAP RETAINS ALL RIGHTS, TITLE, AND INTEREST IN AND TO THE WORKS, INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS AND OTHER INTELLECTUAL PROPERTY RIGHTS THEREIN. THE CLIENT SHALL NOT REPRODUCE, DISTRIBUTE, OR OTHERWISE USE THE WORKS FOR ANY PURPOSE BEYOND THE SCOPE OF THIS AGREEMENT WITHOUT THE EXPRESS WRITTEN CONSENT OF S7NBYAP.
- S7NBYAP retains the right to use any work created for promotional and portfolio purposes.
3. REVISION FEE:
ANY PROJECT THAT HAS BEEN CLOSED AND SUBSEQUENTLY REQUIRES REVISIONS WILL BE SUBJECT TO A REVISION FEE. THE FEE WILL BE DETERMINED BASED ON THE SCOPE OF THE REQUESTED REVISIONS AND WILL BE CHARGED AT THE CURRENT HOURLY RATE OR A FLAT FEE AS AGREED UPON BETWEEN THE CLIENT AND S7NBYAP. THE CLIENT WILL BE NOTIFIED OF THE FEE AMOUNT BEFORE ANY REVISION WORK COMMENCES.
4. SCOPE OF WORK:
- S7NBYAP will provide graphic design services as outlined in the project proposal or agreement. This includes, but is not limited to, logo design, branding, marketing materials, and streetwear designs.
5. PAYMENT TERMS:
- Payment can be made via Venmo, Zelle, Apple Pay, Online Checkout in very few cases, credit card or bank transfer.
- For projects valued at $399 or less, a non-refundable deposit of $80 is required to commence work.
- For projects valued over $399, a non-refundable deposit of 50% of the total project cost is required to commence work.
- S7NBYAP does not recommend that any client pay the full project amount upfront. This policy ensures financial security for both the client and our company.
- The remaining balance is due upon project completion and before final deliverables are released WITH A GRACE PERIOD OF (3) DAYS UNLESS YOU HAVE ASKED FOR AN EXCEPTION BEFORE THE COMPLETION OF THE CURRENT PROJECT ACCORDING TO THE BLESSED BEYOND-SIGHT RECEIPT OF PAYMENT.
IF BY ANY MEANS THE PAYMENT IS NOT RECEIVED WITHIN THE GRACE PERIOD AND THERE IS NO PROPER COMMUNICATION FOR ANY COMPLICATIONS THAT COULD CAUSE DELAY OF PAYMENT THERE WILL BE A $50 LATE FEE IN ADDITION TO YOUR CURRENT FEE.
6. REVISIONS:
- The client is entitled to [10] rounds of revisions as part of the project fee. Additional revisions will be billed at an hourly rate of [$65/hour].
- Revisions do not include changes to the initial project scope.
7. PROJECT TIMELINE:
- S7NBYAP will provide an estimated timeline for project completion. Timelines are subject to change based on client feedback and revision requests.
- Delays caused by the client, including delayed feedback or approval, may result in an extended project timeline.
8. CONFIDENTIALITY:
- S7NBYAP agrees to keep all client personal information confidential and will not disclose any requested project details without prior consent.
9. TERMINATION:
- Either party may terminate the contract with written notice. In the event of termination by the client, S7NBYAP will retain the deposit and any additional costs incurred up to the termination date.
- If S7NBYAP terminates the contract, the client will not receive a refund for any work not yet completed or delivered.
CANCELLATION FEE: THE CLIENT AGREES THAT ANY PROJECT INITIATED BY S7NBYAP, FOR WHICH AN INVOICE HAS BEEN DELIVERED AND SIGNED, OR WORK HAS COMMENCED, WILL INCUR A CANCELLATION FEE. FOR PROJECTS WITH A TOTAL COST UNDER $399, THE CANCELLATION FEE WILL BE $80. FOR PROJECTS WITH A TOTAL COST OVER $399, THE CANCELLATION FEE WILL BE 20% OF THE TOTAL PROJECT COST, EXCLUDING THE DEPOSIT. THIS FEE COVERS THE TIME, RESOURCES, AND EFFORT ALLOCATED TO THE PROJECT UP TO THE POINT OF CANCELLATION."
10. LIABILITY:
- S7NBYAP is not liable for any indirect, special, or consequential damages arising from the project. Our maximum liability is limited to the amount paid by the client for the project.
11. ACCEPTANCE:
- The client’s approval of the final design indicates acceptance of the work. Any further changes after approval will be subject to additional charges.
- By engaging S7NBYAP’s services, the client agrees to the terms outlined in this contractual policy.
12. GOVERNING LAW:
- This contract shall be governed by and construed in accordance with the laws of the United States and the state of [Florida].
Disclaimer:
YOUR SIGNATURE IS REQUIRED ON THE DAY YOU RECEIVE THIS AGREEMENT.
IF YOU DO NOT FOLLOW THROUGH THE PROCESS OF THE INVOICE (signature & deposit) WITHIN A DAY OF THE DELIVERY, YOU WILL BE CHARGED AN ADDITIONAL LATE FEE OF $20 FOR DELAY OF PROCESS.
